1. Basis of Sale
a. These Standard Conditions of sale govern all contracts for the sale of the Company’s goods or the Supply of its Services.
b. Variation of these conditions shall only be binding when agreed in writing by the Company.
c. The Company’s Employees or Agents are not authorized to make any representations concerning the goods or services unless confirmed by the Company in writing.
d. Where these terms mention specifically garage doors they are also to be assumed to cover all products and services supplied by the company.
2. Product Description
All metal garage doors supplied by the Company come in primer or powder coat primer unless otherwise stated.
a. The Customer shall be responsible for the accuracy of the information and the sizes given to the Company for its Goods and supply of Services.
b. Whilst every effort is made to advise the Customer as to the size, mechanism, type etc of the door needed to fit their garage, no responsibility is taken by the Company if measurements and information given by the Customer are inaccurate, non-specific or incomplete.
This includes but is not limited to:
i. The presence of low beams
ii. Gas/electric meters on the sidewalls
iii. Uneven floors or walls being out of plumb
iv. Similar obstructions which would impair the normal fitting and path of travel of the garage door purchased
v. Colour, colour match and design of the door
c. Quotations are not offers and may be withdrawn or revised at any time before acceptance of an order by the Company.
d. Any order that has been accepted by the Company may only be cancelled or amended by the Customer with the written agreement of the Company and on terms whereby the Customer shall indemnify the Company in full against any loss incurred as a result of any such cancellation.
4. Sale of Spare Parts
a. All spare parts ordered ex stock from the Company may only be returned if unopened. All spare parts specially ordered by the Company for a Customer from the manufacturer or their distributor may only be returned if unopened. A re-stocking charge of 25% of the total invoice value of the goods will be levied.
5. Price and Payment
a. All prices quoted are based on current price lists for the goods and are only valid for 30 days.
b. The Company reserves the right to increase the price of goods or services to reflect any increase in cost to the Company especially where additional work / materials are required to complete a job due to unforeseen problems when the customers existing door is removed.
c. Prices Include Delivery unless otherwise specified.
d. All goods are ordered on a supply only basis unless otherwise stated.
e. All garage doors are specially made to order and must be paid for in full at the time of placing the order unless otherwise agreed by the Company.
f. Final payment must be made on the day of completion. The customer gives the company authorization to charge any balance payments due from the same credit/debit card that paid the deposit especially where fitting is done in the absence of the customer.
g. The customer agrees final payment will be made by them or their agent or representative on the day of completion and that failing to do so agrees to pay an additional penalty charge of 5% of the outstanding balance plus a £35.00 administrative fee for each reminder that is sent by the company to them either by post email, telephone call or text message.
h. By making a late final payment the customer agrees to forfeit any warranty offered by the company and will not demand recompense in any form should the product(s) fitted fail in anyway whatsoever.
a. The Customer must make themselves or their Agent available to take delivery. The Agent must be over 18 years of age.
b. The Customer must thoroughly check the condition of the goods at the time of delivery.
c. Goods cannot be signed for as “unchecked” or “unexamined”. If any damage is noted, this must be written as clearly and as accurately as possible onto the delivery note.
d. Notice of any damage must also be given to the company on the same day by telephone and in writing within 24 hours. Damaged goods must remain unused and unfitted, and stored carefully complete with any packaging until the Company or its agent is able to examine the goods.
e. If the Customer fails to take delivery of the goods or fails to give the Company adequate delivery instructions then the Company may arrange to store the goods and charge the Customer for the reasonable costs of such storage and re-delivery cost.
f. Delivery may take up to a maximum of 28 days from date of order depending on the product.
g. Specially made garage doors may take substantially longer to be delivered however lead times are rarely longer than 6 – 8 weeks from cleared deposit but may be longer.
Any lead times stated are estimates only.
7. Replacement Under Warranty
All replacement goods under warranty that have been sold on a supply only basis which have already been fitted by the Customer will be replaced on a supply only basis. If the manufacturer of the goods chooses to install the replacement it is only by their goodwill. Goods which have been fitted by us will receive a 12 month fitting warranty subject to inspection by us. Any warranty inspection will be subject to a £68.00 call out fee. If valid, replacement parts will be provided free of charge but we reserve the right to charge a minimum of £80.00 per hour for labour to replace the parts. We are not able to offer a warranty on any springs we have re-tensioned and can not guarantee the length of time a re-tensioned spring will hold.
a. All garage doors, remote controls and spare parts are sold on a supply only basis, unless otherwise agreed in writing.
b. All garage doors, remote controls and spare parts must be fitted in accordance with the manufacturer’s fitting instructions and no responsibility is taken by the Company for these installations unless the work was carried out by the Company.
c. If the installation is agreed in writing to be performed by the Company:
i. The installation costs specified cover only the work specified and do not, unless expressly stated, include rectification of existing out of square openings or removal or disconnection of electricity or gas fittings or the like, and
ii. The Company shall not be responsible for the removal or taking away and disposing of any old doors unless stated in the estimate, and
iii. Whilst all reasonable care will be taken while drilling and fixing, the Company and its installers shall not be responsible for the failure from any cause whatsoever of any brickwork, masonry, concrete, timber or rendered surfaces whilst fitting the new product and removing the old products.
iv. When installing a door not supplied by ourselves, especially if second hand, the quoted amount does not include any additional equipment, special fixings or spare parts and if they are required a second additional payment is required to cover these costs.
v. After removal of the existing door it is noted that additional materials are required which have not been previously noticed during survey then the company will charge for these items under a second invoice which should be paid within 7 days. The customer will be informed of this additional charge on the day of fitting should it arise.
vi. During installation, if it is found that additional work is required which was not discoverable during survey, example (but not limited to): loose bricks needing re-pointing etc, then we reserve the right to charge for said work or refuse to fit until said work has been completed by the customer.
vii. Duration times of supply / fitting are estimates only.
9. Ownership and Risk
The goods shall remain the property of the Company as legal and equitable owner and no property in them shall pass to the Customer until their full price has been duly paid to and received by the Company together with all other sums whatsoever which are or may become due from the customer.
10. Third Party Liability
The Company shall not be responsible for damage, injury or loss of any kind whatsoever to any property or persons arising from the use of the goods or in connection with the installation of the same.
11. Delay and Force Majeure
a. Any delivery or installation dates given are approximate only and the Company accepts no liability for delay arising from any cause whatsoever.
b. The Company shall not be liable to the Customer or be deemed to be in breach of the contract by reason of any delay in performing, or failure to perform, any obligation of the Company under the contract if such delay or failure was due to any cause beyond the Company’s reasonable control including (but not limited to) Act of God, explosion, flood, tempest, fire, accident, war, threat or hostilities, sabotage, civil disturbance, acts and regulations of any authority, import or export regulations, industrial disputes, difficulties in obtaining materials or labour, power failure or machinery breakdown.
12. Refund & Returns – Internet Orders (Does not include doors).
Under the Distance Selling Regulations you may return, unopened and unused, any item shipped to you for a refund less the original shipping cost providing it is returned within 14 days of the original purchase date. In addition we will refund goods that are found to be faulty and a suitable replacement is not available providing we are informed and the goods are returned within 3 days of giving us notice that the goods are to be returned.
You may request a refund after 14 days providing the item is returned in re-saleable condition however the refund will be subject to a 25% re-stocking fee.
Refunds will be made by BACS or if you paid by credit or debit card, credited directly to the same debit or credit card that you used when placing your order. All refunds will be made within 28 days of receipt of the returned item.
Orders for Doors – we offer a cooling off period under which time one may cancel an order placed, however once we have placed your order with a manufacturer and the order has gone into production then the order may not be cancelled.
For web sales this is 48 hours from the time of the original transaction. You may request a replacement if you have ordered the wrong item but this is subject to an administration charge of 25% of the value of the order.
If you wish to cancel an order after your cooling-off period you may do so but you will forfeit your right to a refund of the deposit. Please note that your cooling off period is the length of time it takes for the deposit to clear. This is 3-7 Business days for Credit Cards. Any purchases made on your behalf from our suppliers / manufacturers are non-refundable once we have placed the order (this includes all garage doors and operators).
The contract shall be governed by English law and the parties submit to the exclusive jurisdiction of the English Courts.
Buying online with us is 100% safe. We use Stripe for simple and secure processing of Internet payments.
15. Repairs & Call Out
We have a standard pricing policy for call out and failed call out charges. These will be discussed on the phone before booking in the job. We reserve the right to amend our rates after inspection of the job. Minimum call out charges shall still apply. Where we are called out and cannot affect the repair immediately you will not be charged unless we have had to spend time working on the door to gain entry. In this case our Gain Entry Charge shall apply (£68 callout + £20 per 15 minutes + VAT.) If the customer is not there when we arrive a minimum call out charge of £68+VAT applies and will be invoiced accordingly. Failure to pay said invoice will result in court action. Our time is precious to us and we cannot afford to have it wasted.
16. Repairs & Call Out for 3rd Parties & Landlords
a. We will quote for third party customers but require full payment in advance of any work being carried out. This applies to unknown (to us) maintenance companies, letting agents and other such companies that request work be carried out for a Landlord or other entity. Where work is carried out at the time of inspection the 3rd Party shall agree to pay the invoice on receipt, meaning the same day / following business day. Failure to do so will incur a £40 per week late payment fee plus interest at 5% of the total invoice.
17. Data Protection
a. We promise never to or share any private data save for what is required in the processing of your orders only. By using our services and purchasing online you agree to allow us to share only minimal information such as name and address in order for us to process your order.
c. Our website will hold securely your order information but will never save your credit card details without your permission. You have the right to request to be “Forgotten” at any time and if this is requested your account will be terminated. However we are still required to keep your transaction data in case HM Government requires this. Records are held for 6 years only.
d. We do not like Spam and will not Spam you with emails or other messages. However if you have taken a repair service or had a new door fitted we may contact you annually to remind you of any annual servicing required by the Manufacturer of the door or operator you have had installed.
